Please read these terms carefully before using GitBrain. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms
By accessing or using GitBrain (the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.
GitBrain is currently in early access. Features, pricing, and terms may change as the product evolves. We will notify registered users of material changes.
2. Description of Service
GitBrain is an Engineering Intelligence platform that captures development activity data (IDE sessions, Git events, terminal usage) from a locally installed agent and transforms it into business metrics for engineering teams.
During the early access period, the Service is provided without charge or at a reduced rate to design partners. Access may be limited, revoked, or altered at our discretion to ensure quality of service.
3. Account & Eligibility
You must be at least 18 years old and authorized to act on behalf of the organization you represent. You are responsible for maintaining the confidentiality of your credentials.
You agree to provide accurate, current information and to notify us promptly of any unauthorized access to your account at hello@gitbrain.ai.
4. User Obligations
You agree not to: (a) reverse engineer, decompile, or disassemble any part of the Service; (b) use the Service to infringe the intellectual property rights of any third party; (c) transmit malicious code or interfere with the Service's infrastructure; (d) share your access credentials with unauthorized parties.
You are solely responsible for ensuring that your use of the Service complies with applicable laws, including employment law, privacy law, and data protection regulations applicable to your organization.
5. Intellectual Property
GitBrain and all associated technology, trademarks, and content remain the exclusive property of GitBrain and its licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
You retain all ownership rights to your data. By using the Service, you grant GitBrain a limited, non-exclusive license to process your data solely to provide and improve the Service.
6. Data & Privacy
Our collection and use of personal data is governed by our Privacy & Security Policy, available at /privacy-security. The local agent never reads source code — it captures only metadata such as file paths, activity durations, and Git event types.
We are committed to GDPR compliance. EU-based users have the right to access, correct, and delete their personal data. Contact hello@gitbrain.ai to exercise these rights.
7. Limitation of Liability
To the maximum extent permitted by law, GitBrain shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages.
GitBrain's total liability for any claim arising under these Terms shall not exceed the amounts paid by you for the Service in the twelve (12) months preceding the claim. During the free early-access period, this liability cap is €100.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
Early access software is inherently unstable. You accept the risk of data loss, downtime, and feature changes inherent in pre-release software.
9. Termination
Either party may terminate access to the Service at any time. We reserve the right to suspend or terminate your access for violation of these Terms, at our sole discretion.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (IP rights, limitation of liability, governing law) will continue to apply.
10. Changes to Terms
We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by French law. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer protection laws in your country of residence provide otherwise.
